Terms and Conditions for Sweepstakes

Only entrants who play a quiz listed on the sweepstake page and answer every question, whether correct or incorrect, and open a 123QUIZ! account can take part in the free prize draw.

2.1

To take part in the respective sweepstake, participants must answer every question of at least one quiz listed on the respective sweepstake page.

2.2

Participants are required to take part in the sweepstakes:

• be at least 18 years old,
• have answered at least one of the quizzes associated with the respective sweepstake,
• have registered a 123QUIZ! account,
• have taken note of and accepted the terms and conditions of participation and data protection regulations,

Participation is only possible online.

2.4

Each participant may only enter and be drawn once per sweepstake. Playing on behalf of third parties or participating via “straw men” is not permitted.

2.5

Persons who use unauthorized aids or otherwise gain advantages through manipulation will be excluded from the sweepstake. In such cases, a win may be subsequently disallowed and reclaimed. Participation via sweepstake services, such as participation via automated sweepstake robots, or any other manipulation is not permitted and will result in the participant being excluded.

2.6

Employees of Mediaworker GmbH, their family members or other persons connected with the sweepstake may not take part.

2.7

By participating in the prize draw, participants are deemed to have accepted and agreed to the terms and conditions. We reserve the right to refuse participation or to refuse to award prizes to anyone who violates these conditions.

3.1

The end of the sweepstake is published on the respective sweepstake page. The sweepstake ends at the end of the specified date.

3.2

It is not possible to substitute winnings with a sum of money of equivalent value.

3.3

Unless otherwise stated in the respective sweepstake, the winners will be drawn within the first two weeks of each new month for the previous month.

3.4

The winners will be chosen at random by a software program. The winner will be selected at random from the group of persons entitled to participate in the respective prize draw.

3.5

The prize to be won is published on the sweepstake page. In the case of non-cash prizes, the winner will be contacted by e-mail and asked for a shipping address. The prize will then be sent to the address provided by the winner. The countries to which the prize can be sent may be restricted on the sweepstake page. If the winner lives in a country that is not listed on the sweepstake page, the prize will be awarded to the next possible winner.

3.6

The prize cannot be exchanged and cannot be transferred to third parties or paid out in cash.

4.1

The winner(s) will be notified by e-mail that they have won. If the winner does not reply within seven days of being informed of the prize, stating their name and zip code, the prize will be forfeited.

4.2

The prize will be sent within ten days of notification of the prize, by e-mail for digital prizes and by post for physical items.

4.3

As proof that a valid prize has been awarded, we will publish the winner’s profile name and country at the bottom of the relevant sweepstake page within two weeks of the draw being completed.

We reserve the right to terminate the sweepstake prematurely in whole or in part at any time, even without observing deadlines, or to change the procedure if the proper execution of the sweepstake cannot be guaranteed for technical or legal reasons.

Legal recourse is excluded with regard to participation in the sweepstake. No claim can be enforced for the payment of winnings.

To the extent permitted by applicable law, under no circumstances will we, our agents or distributors be responsible or liable to compensate winners and accept no liability for any loss, damage, personal injury or death arising from acceptance of a prize unless caused by our negligence or that of our agents, distributors or their employees. The statutory rights are not affected.

Personal data provided in the course of the prize draw will be processed in accordance with our Privacy Policy and subject to the above provisions regarding the announcement of winners.

Amendments or additions to these conditions of participation must be made in writing. This also applies to the waiver of the written form requirement. The prize draw is subject exclusively to German law and participants in the prize draw agree to the jurisdiction of the German courts.

If the participant is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising in connection with the execution of this contractual relationship shall be the place of jurisdiction of the organizer’s registered office.

In the event that individual provisions of these terms and conditions are invalid, the remaining provisions shall remain in force. The invalid provision shall be replaced by the statutory provision.
